1. Defendant B’s purchase and sale of each real estate listed in the separate sheet No. 1 to the Plaintiff on May 31, 2005.

1. Basic facts

A. Nonparty C, D, and E own each of the real estate listed in the separate sheet No. 2 (hereinafter “Defendant B”) as Defendant B’s children (hereinafter “B”) and owns each of the real estate listed in the separate sheet No. 1 (hereinafter “instant real estate”). Nonparty C, D, and E owns each of the real estate listed in the separate sheet No. 2 (hereinafter “instant real estate No. 2”).

B. On May 31, 2005, E.S. purchased all of the instant real estate in the site for the instant implementation project between Defendant B and the seller “Defendant B” and the buyer “SD Nonparty 1” at KRW 1.7 billion. After completing the contract at least 85% of the entire parcel of land prior to the project subject to the project, E.S. entered into a sales contract as follows (hereinafter “instant sales contract”). Defendant B signed the sales contract with the seller’s own unmanned seal affixed to the seller’s column, and E.S. stamped the buyer’s corporate seal affixed to the buyer as the buyer.

Article 1 (General Provisions) of the Agreement on Sale and Purchase of Real Estate shall enter into an agreement between the seller B (hereinafter referred to as the "A") and the buyer and one other (hereinafter referred to as the "B") on the following terms:

Article 3 (Indication of Real Estate) G and H Article 4 (Sale Price)

A. The total purchase amount shall be KRW 1.7 billion.

(b) Sales proceeds shall include all of ground objects and crops related to the sale and purchase real estate;

Article 5 (Conditions and Timing for Payment of Sale Price) In principle, the sale price shall be deposited into a bank account.

Contract deposit: 170 million won - Any balance after the completion of a contract with at least 85 percent of the entire parcel: 1.53 million won.
