Reasons
1. The occurrence and reinstatement of obligee's right of revocation;
A. 1) The Plaintiff’s each land indicated in the separate sheet against C on December 16, 2013 (hereinafter “each land of this case”).
(C) On February 18, 2014, a lawsuit was filed to seek the payment of construction cost under the construction of the foundation (from May 2008 to October 22, 201) and the construction of a new building on the ground (from February 20, 2011 to April 20, 201) and (from February 20, 201, to which the judgment was rendered in favor of the Defendant that “C shall pay to the Plaintiff KRW 37,440,00 and delay damages therefor,” and the above judgment was finalized on March 13, 2014 (Article 2013Ga6091). C donated each of the instant land to the Defendant who is his/her spouse on March 10, 2015 and completed the registration of ownership transfer on each of the instant land (Articles 1 and 2.2).
(A) As of March 10, 2015, as of March 10, 2015, C bears KRW 37,440,00,00 for each of the instant lands to the Defendant, and KRW 10,90,00 for the obligation to guarantee the Defendant’s life insurance company (the result of this court’s order to submit credit information to the Korea Credit Information Institute) while as of active property, C bears KRW 4,00,000 for the market value of KRW 4,661,00 for forest land (hereinafter “D land”) with the total amount of KRW 4,661,00 for each of the instant lands, in addition to each of the instant lands.
(E) A forest land equivalent to KRW 742,716 of the officially assessed individual land price and KRW 1,794 square meters of E forest land (hereinafter “E land”).
