Punishment of the crime

[Criminal Power] Defendant B was sentenced to eight months of imprisonment for fraud at the Incheon District Court on August 7, 2013 and is currently pending in the appeal court.

[2013 Highest 5842] (Defendant B) on December 1, 2012, the Defendant posted a letter that “LG Smart TV will be sold to one million won” on the Internet NAH website at a non-permanent place, and made a false statement to the victim that the victim DH want to purchase, and that “The Defendant will send 8.60,000 won of TV to the Defendant on the one hand after confirming the sea on the one hand.”

However, even if the defendant receives money from the victim, he did not have any intent or ability to send such smart television.

Accordingly, the Defendant, by deceiving the victim as above, received 860,000 won from the victim’s account in the name of A on the same day, and by deceiving the victims from around that time to December 13, 2012, as shown in attached Table 1, and received a total of 3,075,000 won over six times from that time.

[2013 Highest 6611] (Defendant B) on January 2, 2013, the Defendant posted a false statement to the effect that “I would deliver goods if you transfer the price to the company bank account in the name of B” to the victim DI who reported and contacted the above writing.

However, the defendant did not possess the above things at the time, and even if he receives the price from the victim, he did not have the intention or ability to deliver the above things.

As above, the Defendant received 300,000 won from the victim’s bank account in the name of the Defendant on the same day, and had the victims enticed from around that time to February 11, 2013, and received a total of 40,300,000 won from July 7, 2013.
