1. The Defendants shall jointly and severally serve as KRW 299,00,000 on the Plaintiff and as a result, from January 1, 2019 to February 13, 2019.
Reasons
1. The “A” and “A” (hereinafter referred to as “B”) shall enter into a contract with respect to the investment of “B” in the business of “A” as follows.
Article 1 (Period of Contract) The term of this Agreement shall be one year from July 18, 2017 to August 20, 2018.
Article 2 (Investment of Funds and Bearing of Expenses)
1. “B” shall invest 200,000,000 (hereinafter referred to as “investment money”) in “A” as provided in this Agreement.
Article 3 (Termination of Contracts and Return of Investment Principal)
4. Upon the expiration of an investment contract, repayment of the principal of the investment will be made in cash on the date on which “A” and “B” have been consulted after the expiration date of the contract.
Article 5 (Payment of Dividends)
1. “A” shall pay 1,700,000 won per month to “B” for investment dividends of 10% per year.
2. Upon the expiration of the contract period, “A” shall pay KRW 2,000,000 to “B” in cash.
On July 18, 2017, the Plaintiff entered into an investment contract (hereinafter “instant primary investment contract”) with Defendant C Co., Ltd. (hereinafter “C”) on the following terms (hereinafter “instant primary investment contract”) and paid KRW 200,000,000 as the investment amount.
The Investment Contract Co., Ltd (hereinafter referred to as the "A") and A (hereinafter referred to as the "B") shall enter into a contract with respect to the investment of "B" in the business of "A" as follows:
Article 1 (Period of Contract) The term of this Agreement shall be one year from April 30, 2018 to May 30, 2019.
Article 2 (Investment of Funds and Bearing of Expenses)
1. “B” shall invest “A” in the amount of KRW 150,000,000 for daily gold 150,000,000 (hereinafter referred to as “investment”) as prescribed by this title.
Article 3 (Termination of Contracts and Return of Investment Principal)
4. Upon the expiration of an investment contract, repayment of the principal of the investment shall be full at the date on which “A” and “B” have been consulted after the expiration date of the contract.
