A defendant shall be punished by imprisonment for one year.

Punishment of the crime

1. Fraud;

A. On September 2016, the Defendant operates “F” a freight brokerage company holding a regular freight delivery order to the victim E, a cargo vehicle that wishes to enjoy stable profits through regular freight carriage at the D coffee shop located in Busan Metropolitan City Shipping Daegu.

It was suggested to the effect that "the fee of KRW 30,000,000 shall be changed to allow the regular transportation of motor vehicle parts to be transported in the factory located in Busan Metropolitan City, Chungcheongnam-si."

However, in fact, the Defendant did not obtain a cargo transport brokerage business license, and the said “F” did not exist, and the Defendant did not have any intention or ability to provide a regular cargo transport to the victim from the beginning because it did not hold a regular cargo transport order.

Accordingly, the Defendant: (a) by deceiving the victim as above; (b) received a commission of KRW 22 million from the victim on October 7, 2016; and (c) KRW 25 million from the following day; and (d) received a commission of KRW 3 million from September 28, 2016 to October 18, 2016; and (b) unlike other victims, the Defendant, unlike the list of crimes in the attached Form, would simultaneously create “F” from the victim K.

Since the corresponding part was deleted (2,5 pages of the record of the examination of the witness in K) and No. 1 of the list of offenses in attached Form 1.

3 At the same time, the victims were paid a total of KRW 69 million by deceiving victims by the same method.

B. On October 2016, the Defendant called the victim E at the lower end of Busan on the ground that he would purchase G trucks through a used car with the victim E.

If the price of the vehicle is 38 million won, and the incidental expenses are combined, the total purchase price is 50 million won.

It was suggested to the effect that "it should be appropriated for the proceeds by obtaining credit loans from the victim's name."

However, in fact, the defendant's total purchase price of the above cargo is 27 million won, but the difference is 2,950,000 won.
