Punishment of the crime

The Defendant is a person who has obtained permission to engage in development activities to install solar power facilities on a 26,291 square meters in Gyeongnam-gun B.

1. A person who intends to convert a mountainous district into a violation of the National Land Planning and Utilization Act and a violation of the Mountainous Districts Management Act due to construction of stone embankments shall obtain permission from the head of the competent agency, such as the Minister of the Korea Forest Service, according to classification of the types, areas, etc. of mountainous districts prescribed by Presidential Decree, and persons who intend to engage in development activities, such as changing the form and quality of land, shall obtain permission from the competent administrative

Nevertheless, the Defendant did not obtain permission to change the development activities of the competent authority from April 2019 to July 2019, and instead did not obtain permission to install a stone shed with a height of 1.8m high, 4m in length, 435m in length, and diverted mountainous districts without obtaining permission from the competent authority.
