Reasons
Punishment of the crime
On July 21, 2016, the Defendant was sentenced to a two-year suspended sentence of imprisonment for a crime of fraud in order to be punished by imprisonment with prison labor for a two-year period, and the judgment became final and conclusive on July 29, 2016.
1. Around May 2013, the defrauded of the Victim C made a false statement to the Victim C, stating that “The Victim C will enter into a contract with three G Group golf clubs owned by Thaima in Thaima in Thaima in Thaima in Thailand, 30% of the profits will be given, and the principal will be fully repaid by March 2014.”
However, the Defendant did not have any intention or ability to pay the profits and principal, even if he received the money from the victim, because the Defendant did not have any profit from the operation of the enemy.
Around July 28, 2013, the Defendant, by deceiving the victim as above, obtained cash KRW 29 million from the victim, from the departing port of Incheon International Airport.
2. In July 2016, the Defendant entered into a loan loan loan agreement with the victim L-B Co., Ltd., which was the representative of the victim H-B Co., Ltd., in the Seoul Songpa-gu H building I-J office, “If he/she lends ten million won to Thailand a golf course, he/she would pay money up to November 24, 2016.”
However, the defendant did not have any intention or ability to pay the money even if he received the money from the victim because the defendant did not make profits due to the continued operation of the enemy.
Around July 20, 2016, the Defendant, by deceiving K, received money from the victim to the bank account (M) in the name of the Defendant’s child, from the victim, and acquired money from the victim.
