Defendants shall be punished by imprisonment for eight months.
However, from the date of the conclusion of the judgment, each of the above two years against the Defendants.
Reasons
Punishment of the crime
All defendants are constructors.
The Defendants received promissory notes from F, a constructor, at a discount from the victim G in order to raise funds for new E-construction in Cheongju-si.
However, under the condition of the discount of the said promissory note, the victim was required to receive endorsement under the name of H, the contractor of the said inspection, but it was difficult to obtain the consent from H, which led to the following crimes.
1. On February 2, 2010, the Defendants forged securities, on the back of one promissory note in the name of "K," the representative director of J Co., Ltd., and the Defendant L, on the back of the original form in the name of "K," and on the back of the original form in the name of "I", "I", "date of issuance, April 21, 2010", "date of payment," "43,700,000 won," and "I", "I" and "H" were written in the column of the name of the endorser's name in the Dong-dong, Dong-gu, Daejeon, Daejeon, and affixed a seal on the back of the original form.
As a result, the Defendants conspired to forge the above H’s endorsement, which is a description of the rights and obligations of the said Promissory Notes, which is a securities.
2. On February 3, 2010, the Defendants issued the said Promissory Notes upon request for discount to the victims G who may know of the fact that the forged part of the endorsement was genuine, at the same time in the trade name in Yangyang-dong, Daejeon-dong, Daejeon-dong, Daejeon-gu.
Accordingly, the Defendants conspired to use the said promissory note, which is the securities whose endorsement was forged.
3. The Defendants demanded the discount of bills by presenting the said promissory note as if the part of endorsement in the name of the said H was duly formed at the same time and place as indicated in paragraph (2) above.
Therefore, the Defendants are the defendants.
