1. The Defendant shall pay Plaintiff A KRW 34,830,00 and a rate of KRW 15% per annum from September 1, 2017 to the date of complete payment.
Reasons
1. Basic facts
A. 1) The Defendant is a party to the instant project site: (a) the Defendant recruited its members and established a regional housing association, and approximately KRW 131,000 square meters of land in Seo-gu, Seo-gu, Seo-gu, Seo-gu (hereinafter “instant project site”).
(2) The project of constructing apartment units of 2,328 units and ancillary facilities of 29 stories above ground and 29 stories above ground (hereinafter referred to as “instant project”).
2) The E Housing Redevelopment and Improvement Project Association (hereinafter “Redevelopment Cooperative”) is a non-corporate body organized to promote the project of this case, which was established to promote the Housing Redevelopment and Improvement Project which constructs an apartment of 2,586 units and ancillary facilities of 28th underground and above ground in the project site of this case.
B. On February 17, 2015, F entered into a partnership with the Defendant to be supplied with 259,29,293,750 won (249,393,750 won as a partner’s contribution, 9,900,000 won as a first down payment and KRW 9,900,000 as a business deposit and KRW 249,39,393,750 as a member’s contribution, and KRW 249,393,750 as a member’s contribution and KRW 9,90,000 as a business deposit and KRW 249,39,393,750 as a result of the contract, and KRW 14,930,00 as a down payment and KRW 14,930,00 as a remainder of down payment, intermediate payment and remainder shall be paid within one month after the contract, approval for the establishment of the association, and the Defendant shall collectively enter into the partnership with the Plaintiff’s member’s each of the following agreement.
After concluding the contract, until March 26, 2015, the Defendant paid the sum of KRW 34,830,000,000 to the Defendant by March 26, 2015. (2) On December 30, 2015, Plaintiff A succeeded to the rights and obligations of the Defendant’s members under the said contract as a whole.
