A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. No person who violates the Act on the Control of Narcotics, etc. (the act of smoking marijuana) shall commit any act of smoking marijuana, or carry or own marijuana for the purpose of selling or buying it;
