A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. The Defendant is a person who is engaged in driving a driver car B high-speed car.

On May 3, 2020, the Defendant driven the above vehicle at around 19:55, and changed the course from 23.7 km to 2-lanes from 3-lanes in the Gugyeongcheon Expressway.

In such cases, when it is likely that a person engaged in driving motor vehicles may impede normal traffic of other motor vehicles running in the direction of change, he/she shall not change course, and he/she shall be notified of the direction change in advance and have a duty of care to change the lanes safely by making the traffic situation of the front and rear left well known in advance.

Nevertheless, the Defendant neglected this and changed the course from one lane to two lanes while under the influence of alcohol. The Defendant was negligent in driving the victim C(66 years old) driving in the two lanes, followed by the left-hand side of the Plaintiff C (66 years old), and received the part in front of the right-hand part of the Defendant’s vehicle.

2. The Defendant, in violation of the Road Traffic Act, is under the influence of alcohol level of 0.113% at the same time and in the vicinity of Macheon-siJ.
