Reasons
Punishment of the crime
The Defendant, who was working as the D Agent of “C” company, conspired to receive investment money from many unspecified persons under the pretext of paying high profits exceeding the principal, while operating a non-registered multi-level company under the pretext that E, adviser F, G, H, I, I, and J, along with K with private persons, engaged in the sale of sound noise and vibration exercise equipment and chain recruitment business.
1. A person who intends to engage in multi-stage sales business in violation of the Door-to-Door Sales, etc. Act shall register the multi-stage sales business with the Fair Trade Commission or the Special Metropolitan City Mayor, Metropolitan City Mayors, Metropolitan Autonomous City Mayors, Do Governors, and Special Self-Governing Province offices,

The persons concerned with the above companies, including the Defendant, have explained for membership recruitment through the head office, the general sales board, and the agencies affiliated with the general sales board, and have recruited multi-level sales clerks with the following: “If 9.6.8 million won is paid to the N Rental Business of the company, 1,276,000 won exceeding the principal amount in 12 months, 1,450,000 won exceeding the principal amount in 12 months, and 26 million won in P Rental Business, 3,40,000 won exceeding the principal amount in 12 months, shall be paid to the members.”
Persons related to the above companies, including the defendant, shall pay 30,000 won per month as basic salary when recruiting multi-level sales clerks to many and unspecified persons.
