1. The Defendant’s KRW 280,000,000 as well as 6% per annum from May 1, 2014 to October 15, 2014 to the Plaintiff.
Reasons
1. Facts of recognition;
A. The Defendant’s golf course operation background 1) C Co., Ltd. (hereinafter “C”).
(1) On September 1, 1992, after completing the registration of the sports facility business (member golf course business) with the trade name D around September 1, 1992, the golf course (hereinafter “instant golf course”).
The FF Co., Ltd. (hereinafter referred to as “F”) on November 1, 2000 when operating the Company.
2) On May 31, 2001, the Defendant acquired ownership with respect to the land, building, and auxiliary facilities for the instant golf course (hereinafter “instant golf course facilities”) upon receipt of a decision to grant a successful bid (Seoul District Court’s Government Support G).
3) In addition, the Defendant entered into a contract with F on August 9, 2001 under which the registration of the instant golf course is transferred or acquired (hereinafter “instant transfer or acquisition contract”).
A) Upon entering into a contract, on August 21, 2001, the head of Si/Gun revised the registered matters and issued a registration certificate to the Defendant as follows. On August 27, 2001, the name of the non-high sports facility business successor after the change of classification: C(State) representative H corporation name: the name of the non-high sports facility business successor after the change of classification: (D) representative of the BB L in charge of the registration of auction and transfer of real estate on August 9, 2001, the Defendant operated the instant golf course from the time when the above change of registration was completed to the present day.
B. On August 18, 1997, C submitted to the Gyeonggi-do Governor a plan for the recruitment of additional members with the amount of contribution quota recognized as unsold in lots as follows.
