1. The plaintiff's lawsuit against defendant Asian Trust Co., Ltd. shall be dismissed.
2. The plaintiff's defendant corporation.
Reasons
1. Basic facts
A. On February 10, 2012, Defendant Republic of Korea: (a) entered into a business agreement and an agency contract with respect to the construction of an officetel building on a 655 square meters wide on the part of the Seoul Gangdong-gu Seoul Metropolitan Government Gab 35 square meters.
B. On the same day, Defendant 1: (a) concluded the instant trust agreement with Defendant Asian Trust (hereinafter “instant trust agreement”); (b) According to the instant trust agreement, Defendant 1: (c) concluded that, upon completion of the construction of the building, Defendant 2, a truster, additionally trusted real estate under his/her name by means of completing the registration of ownership preservation at the time of completing the construction of the building; (d) at the time of completing the registration of ownership transfer in his/her name; (e) requesting the truster to terminate the registration of ownership to the buyer for the transfer of ownership to the buyer (Article 27(2)); and (e) agreed to manage and trust the said building.
C. On January 14, 2013, before the completion of the instant building, the Plaintiff entered into a contract to purchase the instant real estate at KRW 137,800,000 (hereinafter “instant sales contract”), and deposited KRW 13,780,000 as the down payment on the same day, and KRW 41,340,000 as the intermediate payment on March 13, 2013 into the South Korean Agricultural Cooperative under the name of Defendant Asian Trust and deposited KRW 41,340,00 as the sales contract, and on October 4, 2013, the ownership preservation registration was completed under the name of Defendant Woori Fla on the instant real estate.
On November 20, 2013, the Plaintiff deposited the remainder amount of KRW 82,680,000 and late payment KRW 1,093,301 in the Han Bank account designated by Defendant Woori Fran, and then received the registration of transfer of ownership from the Seoul East East District Court on November 21, 2013 as the registration date of the Seoul Eastern District Court on November 21, 2013, on the ground of sale and purchase of the instant real estate from Defendant Woori Fran, as the registration date of the Seoul East East District Court on November 21, 2013.
