Criminal History Office

1. All facts;

(a) Career of the defendant;

From August 2012, the Defendant had been working as an organization of F Debate and Public Relations Bureau from around November 2013, and performed F Representative from around November 2013, and was in charge of G Joint Representatives from around April 2014.

After the declaration of dissolution around July 1, 2016, the defendant is working as a representative of the Preparatory Committee for the formation of the H Party, which adopted the 5th class of property in power-type corruption, the recovery of pro-Japanese property, the recovery of anti-Korean re-capital, the recovery of anti-U.S. foreign military bases, and the recovery of foreign military bases.

B. The anti-government organization of North Korea

In the text of the Code of the Joseon Labor Party, North Korea established the basic goal of the unification of the Korean Peninsula based on Kim Il-sung's Dominology (the so-called "main ideology") by providing that "the purpose of North Korea is to build the socialist state in the North part of the Republic of Korea, to conduct the task of the Korean Maritime Democratic Democratic Democratic Revolution within the scope of the nation, and to fully realize the independence of the people by making the society which has been finally aimed at realizing the independence of the people through Kim Il- Geun-Gun's Dominism."

G maintained the above basic organization system and expanded the organization by appointing A (Defendants), AR, and AF as new joint representatives after April 2014, and including new researchers.

(ii)aptitude and substantial danger;

In order to define South Korea as an anti-capitalistic society in the U.S., G is actively accepting the theory of the anti-state democratic revolution, which is an anti-government organization, such as the US bar, abolition of the National Security Act, establishment of the South Korean independent democratic regime, and the federal system unification with the North Korean socialist system, such as the strategy of the anti-capitalistic revolution in the North Korea’s unification cable prior to the unification cable.

C) Connection with North Korea

The total amount of K is sentenced to 8 years of imprisonment for the crime of violating the National Security Act (espionage), and there is a history of criminal punishment of 0 joint representatives, L, AF, P in charge of finance, and AI secretariat AZ prior to the formation of G.

Joint Representative N, L, AF, and P in charge of finance were sentenced to 2 years of imprisonment with prison labor for each violation of the National Security Act in relation to the composition of G, and AB was sentenced to 1 year and 6 months of imprisonment with prison labor for the core organization, 3 years of suspended execution for 2 years of imprisonment, A, and B were sentenced to 3 years of suspended execution for 1 year and 6 months of imprisonment.

In addition, A. Q and B, which are the core organization, violated the National Security Act in relation to the composition of G, are sentenced to 1 year and 6 months of imprisonment, and AE is sentenced to 3 years of suspended sentence in 1 year and 6 months of imprisonment, and pending the final appeal.

E) On November 2010, the members of North Korea’s activities to instigate South and North Korea through the Internet and other publicity media participated in the publication of “E” from the beginning of the “E” around November 2010, and after the establishment of G, they were produced and distributed every other month using it as an engine.

In addition, G announced from May 2012 to February 2016 through G homepage 100 copies of a statement of name and white paper claiming a prior civil defense dispute, such as the anti-U.S. and anti-government war. From July 2013 to June 2016, G continuously proceeded with anti-U.S. and anti-government assembly and propaganda activities. From June 2015 to June 2016, G announced 19 U.S. Embassy members, including the Defendant, 2 to 2-3 of G staff members of the G, including the U.S. Embassy, called “U.S. Embassy Ro”, and carried out a demonstration on the 19th of the U.S. Embassy 19th of May 2016, 200.

In addition, when the co-representatives of G, including L, P, N, P, and other employees were detained, G officers including the Defendant committed a demonstration by asserting for the release of detained persons, the National Security Act, etc. in front of the Seoul detention center from August 11, 2015, and continued one person’s demonstration by asserting that the Agreement on the Peace of North Korea was concluded between May 20, 2015 and June 28, 2016, and one person’s demonstration was concluded in the vicinity of the U.S. Embassy, and one person’s demonstration continued.

3) Sub-determination

As above, G is an organization in the form of annual substitution established to succeed to the ideology and activities of Q and to implement the strategy of North Korea's revolution, and is an anti-government organization with the knowledge that it may endanger the existence and security of the State or democratic fundamental order, and is an anti-government organization with the aim of praiseing, encouraging, promoting, promoting, or aiding and abetting the activities of North Korea and its members or persons who were ordered by it.

2. Criminal facts;

A. On November 2011, 201, G core staff, including ENK, L, N, P, etc. organized G as described in paragraph (1)(c) above, and subsequently, organized internal organizations such as the General Assembly, Steering Committee, Board of Education and Executive Committee, etc., and established regional organizations such as Chungcheongnam, Seoul, and youth-related sector organizations, labor-related witness organizations, etc. as part of the organization strengthening project, and tried to rearrange the regional organizations and sector organizations under G-affiliated.

Accordingly, the core researchers such as L and N decided to form a 'AH' as a general substitution for four organizations such as ‘BE', ‘F', ‘BF', ‘BG Seoul Branch', and the 'AH' were prepared to form an organization system such as the appointment of N, AR, N, BH as joint representatives, and the appointment of BI as chairperson of the enforcement committee.

On the other hand, the Defendant, who was launched on August 11, 2012, planned to discuss the whole debate and lecture team in the second half of the F (representative BH) year as an affiliated staff member of the debate and public relations bureau at the inaugural general meeting. On August 21, 2012, the Defendant, who was engaged in the activities in F, leading in the activities of F, such as delivering the data collection of the F inaugural general meeting to Q Q, a central operating member of the G central operating committee.

After that, around 19:00 on April 13, 2013, G core researchers L, N, P, etc. held a ceremony of forming 'AH' at the BK center located in Mapo-gu Seoul Metropolitan Government BJ, and the Defendant participated in the above AH formation ceremony as a member of F, a constituent organization.

The participants, including the defendant, proposed the relief that "G" in the above formation formula, "G" is the front letter and the front letter of self-united unification, and the formation formula was carried out in the order of the encouragement of important participants, such as G joint representatives, or stables, reports on the progress of activities, explanation of the direction of activities, statements of affiliated organizations, N's formation declarations, reading, etc.

After AH was elected as a joint representative of G around April 2014. On June 12, 2014, the Defendant appeared at the 984 meeting organized by the National Security Act, which was held by the National Assembly for Dematization and Family Movement on June 12, 2014, and speaked that “the suspension of Korean military training and the improvement of inter-Korean relations” is “the suspension of Chinese military training and the improvement of inter-Korean relations”. 그밖에 피고인은 2014. 7.경 G 인터넷 선전매체인 팟캐스트 방송 진행을 맡아 K과 함께 'BZ이 최고 리더'라며 우상화함과 동시에 "북한의 선군혁명 이론을 찬양하고 북한의 혁명무력을 주도로, 북·남·해외 민족통일전선을 보조혁명 역량으로 하여 자주민주통일을 이루어야한다"는 내용의 방송을 제작하기 시작하였고, 2016. 1. 4. 프랑스로 출국하여서도 위 방송을 계속 진행하였으며, 2016. 6. 7. 프랑스에서 귀국한 다음 CD 광화문광장에서 개최된 CE 등 집회를 주도하며 'CF 군사파쇼정권을 민중의 거대한 힘으로 무너뜨렸으나, 그 파시즘은 BN정부에 의해 되살아나 자주통일과 민주주의를 위해 헌신하는 활동가들을 탄압하고 민중을 억압하고 있다'고 발언하는 등 G 공동대표로서 G의 선전·선동 활동을 지속하였다.

B. Recognizing the necessity of female organizations consisting of many of the researchers since the launch of the G, the core researchers, such as Lee Dong-dong AF, and P, related to attending the AM formation form, and the organization of "AM," which is a female sector organization centering around AF, AJ, BB, Z, ZN, and BA, and the former CG Vice-Chairperson, as BF representative, and the AJ, the wife of G Full-time AD, as CH representative, was prepared for the formation of "AM."

G Women's investigators held 'CJ conference' in front of the U.S. Embassy located in Jongno-gu Seoul Metropolitan Government Embassy at around 11:00 prior to holding the 'AM' formation consciousness, and announced 'AM peace declaration', the main contents are as follows. BN government urge the BN government to suspend war practice, dismiss anti-North Korea War Veterans, and make a federal parliamentary declaration. On the other hand, on April 19, 2013, the Defendant was sent e-mail under the “AM satisfaction type order” attached by the file to the effect that from P around 19:47 on April 19, 2013, the Defendant is proceeding from 13:30 to 17:20 to the Defendant’s society. The Defendant was sent e-mail under the “AM type order” with the content that the participants and introduction of the participants, talks about the life in the cN’s writing, and is going in the order of the former CO of Gangwon-do.

After that, around 13:30 on April 20, 2013, 200 G female researchers, including Z and BA, held a form of "AM" in Q Q, located in Seodaemun-gu Seoul, Seodaemun-gu, Seoul, and the Defendant participated in the form of a social group as a single copy of the event.

The Defendant: (a) had one-time event society; (b) had been entrusted with a double-class meeting; (c) had been carried out in the order of the public funeral; (d) the staff of representatives; (e) the introduction of organizations by AF; and (e) the presentation of future plans; and (e) reading of the text of the formation declaration by representatives.

The purpose of rubber, propaganda, or aiding and abetting is to determine that the actual activity also constitutes a dual organization that has a risk of substantial harm to the existence and security of the Republic of Korea or democratic fundamental order (see Supreme Court Decision 2016Do8137, Oct. 13, 2016);

G does not accept the above assertion that it is not a dual organization.

A. Summary of the assertion

Although the defendant was present in the AM formation form as stated in the facts charged and held a meeting of CE, etc., it cannot be said that the participation in the formation form and the holding of the meeting can not be seen as an equitable group.

B. Determination

1) According to the facts acknowledged earlier, AM constitutes an affiliate organization of G, which is a dual organization, and the Defendant’s act of attending the aforementioned formation form and proceeding with the formation of a single-class event society may be deemed to have expressed his/her external intent to actively respond to and go against the activities of anti-government organizations, etc. by externally declaring the organization of AM. Furthermore, the Defendant was involved in holding an formation ceremony, such as attending the formation ceremony with the knowledge of what he/she would be engaged in, and entrusting the society. As such, the Defendant is deemed to have engaged in the act of inter-government in collusion with other G trillion staff members.

2) As seen earlier, as recognized by the Defendant, an act of attending each assembly held by G in the capacity of joint representatives of G, which is an immigration organization, and speaking in a resolution to see and fight against the letter of name presented by G in the capacity of joint representatives of G, and an act of taking relief out and taking action with G trillion staff members, may be evaluated as having actively expressed the intent of responding to and responding to the activities of anti-government organizations, etc.

However, as to the facts charged that the Defendant kept 284 copies of “D” in his/her G office, G was dissolved as of July 1, 2016, and the above office was not a space exclusively occupied and managed by the Defendant, and thus, it cannot be deemed that the Defendant possessed the said book.

2) The “D” book does not constitute pro-enemy contents, and even if they constitute pro-enemy contents, the Defendant did not have any pro-enemy purpose under Article 7(5) of the National Security Act.

B. Relevant legal principles

1) To be recognized as pro-enemy contents under the National Security Act, the contents of the expressive materials must be active and aggressive to threaten the nation’s existence and security and the democratic fundamental order, which are protected legal interests under the National Security Act. Whether the expressive materials have such nature should be determined by taking into account not only the overall contents of the expressive materials, but also all the circumstances, such as the motive for production, the form of the expressive act itself, the external relation with the expressive act, and the situation at the time of expressive act (see, e.g., Supreme Court en banc Decision 2010Do1189, Jul. 23,

2) The fact that an actor is aware that he/she was a pro-enemy pro-enemy organization and committed an act under Article 7(5) of the National Security Act does not necessarily mean that he/she committed a pro-enemy act with the intent to commit a pro-enemy act. In cases where there is no direct evidence to prove that the actor committed a pro-enemy act, the determination may be made by comprehensively taking into account the indirect facts, such as the Defendant’s career and status, background and status in relation to the pro-enemy organization in addition to the various circumstances indicated in the emulation of the pro-enemy organization; circumstances leading the Defendant to commit an act under paragraph (5) in relation to pro-enemy organization; whether the Defendant was a pro-enemy organization; and the relationship between the pro-enemy organization to which the Defendant belongs

C. Determination as to the defendant's possession of the expressive materials confiscated in the office

1) Facts of recognition

The following facts are acknowledged according to the evidence duly adopted and investigated by this Court.

① Around May 10, 2016, the husband DW of the Defendant entered into a lease agreement with the Defendant under the name of the Defendant, Dongdaemun-gu Seoul Dongdaemun-gu Seoul, and on the same day, the name of the consumer of electricity changed to the Defendant.

② A total of 1-7-class 7-class 7-class 284 in the holding is an institution published by G on a monthly basis as follows. On July 21, 2016, the investigative agency discovered in Dongdaemun-gu Seoul Dongdaemun-gu DK and seized from the Defendant.

④ Around July 1, 2016, G announced that it would be dissolved. However, on August 2, 2016, K, a general book of G, published in the column of “AV website,” which is an agency of G, a non-government organization, in which many articles are attached to North Korea’s assertion, such as tamply defending North Korea, which is an anti-government organization, and inserting a large number of articles in which North Korea’s assertion was presented. As a result of the announcement of G’s dissolution, G did not completely terminate its activities even on July 21, 2016.

2) Determination

In light of the above position of the defendant, the place where the expressive materials were seized, and the situation at the time of seizure, it is reasonable to view that each expressive material seized by the defendant was "bearing" under the control of the defendant at the above location. It does not necessarily mean that such expressive material was "bearing" in the exclusive possession and management space as the defendant's assertion. The above assertion that expressive material seized in the office is not held by the defendant is not accepted.

(d) Determination as to whether a expressive material(D) has an interest in, and whether there exists an interest in, an act of expression(D);

Among the contents stated in D'D', the expression itself itself does not seem to be active and aggressive to threaten the existence and security of the nation and democratic fundamental order (D'2'), and in excess of reality, university education and democracy in Europe and democracy in Europe, and law and justice).

However, as seen earlier, most of the materials described in the above expressive materials (D) are written by K and M, etc. by the core staff of G. The contents of the materials include the following: (a) the prosecution or praise of North Korea, such as the military politics and the principal ideology, etc. claimed by North Korea; (b) the first. J.BZ’s political guidance power, etc., (c) the Republic of Korea as pro-friendly regime; (d) the U.S. Armed Forces in Korea; and (c) the United States Armed Forces in Korea, and the federal system unification scheme. Even if considering the need to capture any other perspective according to the freedom of expression and the development process of our society, such expressions constitute active and aggressive acts that threaten the existence and security of the Republic of Korea and democratic fundamental order.

In addition, according to the evidence duly adopted and examined by this court, the publisher and compilation of 'E' were the joint representative of 'E', N &O, and compilation members were K, which are the total books of 'E', and it is recognized that 'E' was directly involved in all publication processes, such as editing, printing, and sending of 'E', 'E' itself means 'E' in 'BC broadcasting as the agency of G'. 'D' also is similar to 'E, the publisher and compilation chief 'E', 'K, 'D' and 'E' are the same as 'DX', 'e-mail is the same as 'DX', 'D', 'D', most of which are the core staff of 'E', 'E', and 'E' as 'E'.

In light of the fact-finding and the above fact-finding and the fact-finding, it is reasonable to regard D's pro-enemy as constituting pro-enemy pro-enemy, in view of the fact that the publication of such expressive materials is a part of the G activities, and that the publication itself is a part of the G activities.

Therefore, we cannot accept all of the arguments of the defendant and the defense counsel.

Reasons for sentencing

1. Scope of punishment by law: Imprisonment with prison labor for not less than one year but not more than 45 years;

2. Scope of recommending sentencing criteria: The fact that the sentencing criteria of the Supreme Court are not set.

3. Determination of sentence: 1 year and six months of imprisonment, 3 years of suspended execution, 3 years of suspended qualification and 3 years of freedom of expression are essential elements of a democratic system, but it is inevitable to restrict if it threatens the existence and security of the State and the liberal democratic fundamental order, not unlimited recognition. Although North Korea is accompanied by dialogue and cooperation for peaceful unification, it is also the character of anti-government organization that still seeks to reverse the liberal democratic system of the Republic of Korea while maintaining the routes of peaceful unification. Thus, it is difficult to permit North Korea, beyond discussions and studies on academic unification at the same academic level, to endanger the liberal democratic state system.

G is a dual organization that has carried out an active activity as a joint representative of G, which is a dual organization, and North Korea still threatens our free democracy system, and it is inevitable to punish corresponding violations of the National Security Act as stated in its reasoning in the present situation where North Korea still threatens our free democracy system.

다만, 피고인이 G의 결성 과정에 관여한 것은 아니고, 2014. 4.경부터 G의 공동대표 직위를 가지고 있기는 했으나 다른 공동대표들과 비교하여 주도적으로 활동한 것으로는 보이지 않는 점, 피고인이 폭력적인 수단을 통하여 국가의 존립·안전이나 자유민주적 기본질서를 전복·폐지할 것을 직접적으로 기도하거나 선전·선동하지는 않은 점, 판시 팟캐스트 방송 진행으로 인한 이적동조 부분은 대부분 K이 적극적으로 대화를 주도하고 피고인은 K이 하는 말에 호응하며 방송을 진행하는 정도로 보이는 점, 피고인은 G 활동으로 인한 집회및시위에관한법률위반죄로 재판 계속중인 것 외에는 범죄전력이 없는 점 등 피고인에게 유리한 정상도 있다.
