Defendants shall be punished by imprisonment for ten months.
However, from the date of the conclusion of the judgment, the Defendants are above two years from the date of the judgment.
Reasons
Punishment of the crime
The Defendants acquired the card information (credit number and effective period) of customers at the time of payment by means of writing the card information (fence) at the time of payment, etc., and intented to purchase the goods by accessing the U.S. shopping mall Amazon site (www.amazon.com) that does not confirm the personal information at the time of payment, settle the payment by using the said credit card information, and then receive the goods from the Internet as the place of receiving the neighboring guard room, etc., and sell the goods via the Internet-oriented goods transaction site.
On December 4, 2014, the Defendants: (a) purchased Samsung Sart LD TV, the market price of USD 2,244 ($$2,00) from the victim’s name influence; and (b) made use of another’s credit card information (E) discovered by such unlawful means as above, the Defendants attempted to enter the card number and the validity period in the settlement column as if they were entitled to use the said card number; (c) continuously pay the amount by entering the card number and the validity period into the settlement column; and (d) the victim’s me, the overseas shipping agent, who is the overseas shipping agent, continued to connect the victim’s me to the Internet site (poS.M.com) in the territory of Korea, and attempted to obtain the goods and the delivery charge by settling the 295 US$295 ($) using the said card information, but did not commit the attempted delivery of the goods to the victim.
The Defendants, using other person’s credit card information discovered by unlawful means from the above day to June 17, 2015, received goods and services equivalent to USD 27,165 ($ 24,311, delivery expenses, and KRW 2,854) in total from the victims on 25 occasions, such as the list of crimes in the attached list of crimes, and attempted to receive goods and services from the victims, but failed to deliver goods.
