그럼에도 피고인 A은 전방 주시의무를 태만 히 한 채 만연히 진행한 과실로, 마침 같은 방향 전방에서 진행 중이 던 피해자 E(61 세) 이 운전하는 경운기 적재함 부분을 위 화물차의 앞 범퍼 부분으로 들이받음으로 인해 피해자로 하여금 위 경운기에서 튕겨 나가 위 도로 맞은편 2 차로에 떨어지게 하였고, 그로부터 약 2분 후 B이 운전하는 F SM5 승용 차가 위 도로를 노은면 쪽에서 중앙탑 면 쪽으로 진행하다가 피고인 A이 피해자를 흔들어 깨우는 것을 보지 못하고 위 승용차의 바퀴로 피해자의 몸통 등을 밟고 지나갔다.
