1. The judgment of the court of first instance is modified as follows.
Of the instant lawsuit, the Suwon District Court against the Defendant’s Plaintiff.
Reasons
1. Facts of recognition;
A. On February 16, 2012, the Plaintiff sold 200 million won the medical equipment in custody of the Plaintiff to C in the voice warehouse, and the amount of KRW 50 million out of which was paid before the delivery of the goods from the voice warehouse, and the remainder of KRW 150 million was paid to C in the warehouse designated by C.
B. Accordingly, on March 16, 2012, C and the Defendant entrusted the Defendant with the custody of medical equipment, and paid KRW 880,000 per month (10% of the late payment penalty) as storage fees, and C concluded an entrustment contract for cargo storage (hereinafter “instant depositing contract”).
C. At the time of the instant deposit contract, the Plaintiff visited the Defendant’s warehouse along with C, and participated in it. At the time of the instant deposit contract, the Plaintiff permitted the Defendant to enter the Plaintiff’s name (hereinafter “D”) and telephone number in the column for contracting parties to the instant deposit contract.
After the conclusion of the instant deposit contract, C paid storage fees by the payment of storage fees, etc. from September 15, 2012, but later, the payment of storage fees was overdue, and thereafter, the Plaintiff paid to the Defendant KRW 200,000 on March 29, 2013, KRW 200,000 on April 30, 2014, KRW 100,000 on January 11, 2016, and KRW 250,000 on April 8, 2016 to cover part of the principal.
E. On January 9, 2016, the Defendant urged the Plaintiff to pay the storage fees several times, and notified the Plaintiff that he will apply for an auction if the storage fees are not paid, and the Plaintiff will be arranged on January 18, 2016.
