1. From May 6, 2016 to November 25, 2016, Defendant Veterans General Construction Co., Ltd.: (a) KRW 38,500,000 to the Plaintiff; and (b)
Reasons
1. Basic facts
A. On July 15, 2015, a master plan for the establishment of facilities for education, culture, and complex (hereinafter “instant project”) was publicly announced by the Master Plan for the Symna University’s Symnas University (hereinafter “Synas”).
B. Defendant D&C Co., Ltd. (20% of the equity interest; hereinafter the same shall apply), Defendant General Construction Co., Ltd. (10% of the equity interest; hereinafter referred to as “Defendant Veterans General Construction”), KD Infrastructure Asset Management Co., Ltd. (40% of the equity interest), KD Infrastructure Asset Management Co., Ltd. (10%), KSV Co., Ltd. (10% of the equity interest), and KSM Co., Ltd. (10% of the equity interest) decided to establish a consortium in order to be designated as a business entity of the instant project, and to establish (tentatively named) M&D global Co., Ltd. (hereinafter referred to as “SB global”).
C. On October 6, 2015, Defendant Veterans General Construction concluded a service contract to prepare and advise the following business plans (hereinafter “instant service contract”) with the Plaintiff.
The purpose of service is to perform advisory services on each of the following paragraphs with respect to the designation of a person subject to preferential negotiations on the instant project by Defendant Veterans General Construction and the designation of a project implementer (Article 1), and the following items:
