피고인은 2013. 4. 3. 17:00경 서울 영등포구 B에 있는 ‘C식당’에서 담배를 피우는 자신을 업주 D이 제지하자 소란을 피워 신고를 받고 출동한 피해자인 서울영등포경찰서 E지구대 소속 경찰관 F이 담배를 피우지 말라고 하였다는 이유로 위 D, 종업원 G, 손님 등이 지켜보는 가운데 피해자에게 “야, 이 씹쌔끼야, 씨발새끼야, 니가 뭔데 나한테 지랄이냐, 짭새 새끼가 개지랄이냐, 미친 새끼야”라고 큰소리로 말하여 공연히 피해자를 모욕하였다.
