The Defendant (Counterclaim Plaintiff) E and F are real estate listed in the attached table No. 1 to the Plaintiff (Counterclaim Defendant) B, and B.
Reasons
1. Basic facts
A. On June 28, 2002, with respect to the construction of a new apartment house on the 4th parcel, such as Gwanak-gu in Seoul Special Metropolitan City, J, when Plaintiff A newly built 19 households on the above site between L, M, N, the owner of the above site and the owner of the building, the 5 households out of which belong to L, and the remaining 14 households, including M and N shares, are transferred to Plaintiff A, and the households sold in lots among the apartment houses, completed the registration of ownership transfer in the name of the buyer or occupant.
B. On December 31, 2002, with the approval of use on May 28, 2004, the registration of ownership preservation was completed in the proportion of one-third shares in L, M, and N on May 28, 2004. On July 17, 2008, with respect to M, N, and 401 and 402 listed in the attached list, the registration of ownership transfer (one-six shares each) was completed on July 10, 2008 on July 10, 2008.
C. With respect to the above 203, 303, and 401, the registration of the provisional injunction against the disposition made by the plaintiff A, the debtor M, and N on October 6, 2008 was completed on October 6, 2008 (Seoul Central District Court 2008Kahap3301). As to the above 203 on November 14, 2008 as to the above 203 as to the defendant E, F, and the above 303 on November 14, 2008, the registration of ownership transfer was completed on October 20, 200 in the name of theO (the defendant I's Form) designated by the defendant I as to the above 402, respectively.
Since then, with respect to the above 203, 303, and 401, the registration of ownership transfer was cancelled after the registration of the above provisional disposition was made, and the registration of ownership transfer was completed on the ground of the letter of agreement performance as of May 22, 2015 and June 23, 2015, the registration of ownership transfer was completed on June 23, 2015, respectively.
E. Defendant E and F occupied and used the above 203 around June 15, 2006, and Defendant G occupied and used the above 303 from July 2002. Defendant H from around 2008.
