A defendant shall be punished by imprisonment for one year.

Punishment of the crime

From around 201, the Defendant had been engaged in metal-type sales business in the name of "D" on the Jongno-gu Seoul Metropolitan Government 1st floor, and received orders for the metal-type type (hereinafter referred to as the "fin metal type") in which a trademark identical or similar to a name trademark is inscribed, and had been able to run a fake metal type sales business in good faith by leasing a storage of the first floor E in Yongsan-gu, Youngyang-gu, Busan Metropolitan City around January 2012.

From January 2012 to March 5, 2013, the Defendant received an order from a household manufacturer whose name cannot be known at the above office to sell a fake metal package to attach it on the bags, etc. of a fake trademark, and from an intermediate merchant whose name cannot be known, the Defendant infringed the said trademark right by acquiring more than 100,000 won in a shape identical to the trademark “LUIS VUTON” (Trademark No. 059471) of the trademark right holder, which is the registered trademark “LUSS VUTON” (Trademark No. 059471) from an intermediate merchant to whom the name cannot be known.

2. 피고인은 2013. 3. 5.경 일산에 있는 위 창고에서 판매할 목적으로 상표권자 ‘루이비똥 말레띠에’의 등록상표인 ‘LOUIS VUITTON'(상표등록번호 제059471호)과 동일한 모양의 위조 상표가 새겨진 가방고리장식용 금속장식 27,200점을 비롯하여 별지 목록 범죄일람표 기재와 같이 위 창고와 위 사무실에서 ’HERMES(에르메스)‘(상표등록번호 제0632660호), ’MCM(엠씨엠)‘(상표등록번호 제0148830호), ’GUCCI(구찌)‘(상표등록번호 제0070352호), ’CHANEL(샤넬)‘(상표등록번호 제0071324호), ’PRADA(프라다)‘(상표등록번호 제404466호) 등 총 6개 등록상표와 동일한 모양의 위조 상표가 새겨진 가짜 금속장식 총 760,426점 및 가짜 ’루이비똥‘ 가방 6점(정품추정시가 합계 1,148,712,000원)을 보관함으로써 각 상표권을 침해하였다.
