1. Defendant D shall pay to the Plaintiff KRW 480,00,000 and KRW 449,616,178 among them, with full payment from May 13, 2014.

1. Basic facts

A. From December 23, 2002, the Plaintiff owned Gagra's mobile building located in Cheongju-si, a total of 19 households. A half floor consisting of 101, 1st to 201, 201 to 306, 301 to 406, 306, and 401 to 406 (hereinafter "the instant building").

B. The Defendant Direct Energy Co., Ltd. (hereinafter “Defendant Direct Energy”) is a company engaged in the business of constructing liquefied petroleum gas sales and physical facilities construction, and supplied LPG gas in the instant building.

C. On the other hand, on November 27, 2010, the Plaintiff decided to sell the instant building to Defendant C at KRW 210 million, and the down payment of KRW 20 million was paid on the 29th day of the same month as the date of the contract, and the intermediate payment of KRW 30 million on December 3 of the same year.

(The amount of KRW 160 million was paid on January 5, 201). D.

After the above sales contract, Defendant C decided to undertake repair of the building of this case with the consent of the Plaintiff.

On December 5, 2010, Defendant C awarded to Defendant D the instant construction on the 111st generation of the instant building (except subparagraph 101) with the inner toilet waterproof construction and tinboard attached to the existing wall (hereinafter “instant construction”). Defendant D began the instant construction in the instant building around that time.

E. Defendant E had resided with his family since he leased the instant building 101 from the Plaintiff around July 2006.

F. However, at around 19:30 on December 30, 2010, the instant fire occurred due to gas explosion (hereinafter “instant fire”).

Due to the fire of this case, H and I resided in No. 101 and No. 401 of the instant building, respectively, were killed, and the instant building and the Gag-dong building, which is located adjacent to the instant building, were relocated to the lower court.

G. The deceased I’s bereaved family members are the occupants of a structure based on Article 758(1) of the Civil Act against the Plaintiff and Defendant D.
