Defendant shall be punished by imprisonment for a term of one year and two months.

However, the above sentence shall be executed for a period of two years from the date this judgment became final.

Punishment of the crime

On July 29, 2008, the Defendant issued a summary order of KRW 2 million for a crime of violation of the Road Traffic Act at the Busan District Court, and on September 24, 2008, the above court was sentenced to a fine of KRW 3 million for a crime of violation of the Road Traffic Act (Refusal of measurement). On August 16, 2013, the Defendant was issued a summary order of KRW 4 million for a crime of violation of the Road Traffic Act (driving) at the Changwon District Court Seoyang Branch Branch on August 16, 2013.

1. On August 24, 2019, the Defendant: (a) driven a motor vehicle with low distance from 04:41 to 04:41 to 00% of blood alcohol concentration; (b) the Defendant driven a motor vehicle with low distance while under the influence of alcohol level of 0.090%.

As a result, the defendant violated the drinking driving or drinking test refusal twice or more.

2. 공무집행방해 피고인은 위 일시경 김해시 B 앞 편도 4차로의 도로 중 3차로에서 술에 취해 위 차량을 정차한 뒤 차량 안에서 잠을 자던 중, ‘차가 도로에서 멈춰 움직이지 않아 사고가 날 것 같다’는 내용의 112신고를 받고 출동한 김해서부경찰서 D지구대 소속 경장 E이 갓길로 이동한 뒤 음주측정을 하기 위해 피고인을 순찰차에 태우고 피고인에게 차키를 달라고 요청하자, 차량 열쇠를 주는 것을 거부하며 순찰차에서 내려 위 E을 밀치고 도주하려 하였고, E이 이를 저지하기 위해 피고인의 앞을 가로막자 발로 E의 다리를 2회 걷어찼다.

As a result, the Defendant interfered with the legitimate execution of duties by police officers concerning the handling of reported cases.
