Punishment of the crime

1. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Bodily Injury resulting from Dangerous Driving) is a person engaging in driving cars BM5

On February 15, 2020, the Defendant driven the said car while under the influence of alcohol of 0.116% of blood alcohol concentration around 03:04, and driven the said car at a speed of about 233 km as the citizen of the Gu during the Ansan-si and the front road along the intersection of viewing company distance from the area of the sports complex to the area of the flat Central Park at a speed of about 147km/h.

Since there is an intersection where signal apparatus is installed in the front bank and the restricted speed is 50km/h road, the defendant engaged in driving service has a duty of care to live well on the front side and the left side, to observe the restricted speed, and to proceed in accordance with good faith.

Nevertheless, the Defendant was negligent in performing his duty of care in a state where normal driving is difficult due to such influence of drinking, and due to the negligence of entering the said intersection beyond about 97 km/h of the speed and going so far, the Defendant was faced with the front part of the car driven by the Defendant, driving by the victim C ( South, 45 years old) who was going straight from the left side of the Defendant, along with the right straight signal.

The Defendant, due to the above occupational negligence, suffered injury to the victim C, such as a cage at the right cage, etc. which requires approximately four weeks of medical treatment, and injury to the victim E (Nam, 42 years of age) who was accompanied by the Defendant’s car, such as face cages necessary for medical treatment for about two weeks.

2. Around 03:04 on February 15, 2020, the Defendant driven a BM5 vehicle under the influence of alcohol with a blood alcohol content of 0.116% from the front of the F apartment Gdong in Ansan-si to the front road of the 233km as the citizen of the same Gu, and from the 4km section to the front road of the viewing company street crossing to the front road.
