In full view of the purport of the entire arguments in Gap evidence No. 1 and evidence No. 6 regarding the cause of the claim, the defendant is obligated to deliver the real estate listed in the separate sheet to the plaintiff, unless there are special circumstances according to the above facts of recognition.

2. Judgment on the defendant's assertion

A. As to this, the Defendant asserts that, although he did not pay a part of the monthly rent to the Plaintiff, it is true that the Plaintiff, as a lessor, has the duty to maintain the conditions necessary for the use and profit-making of the leased object while the lease contract remains in existence as prescribed in Article 623 of the Civil Act, the Defendant did not pay the Plaintiff in arrears as such, and thus, the Plaintiff cannot respond to the Plaintiff’s claim.

B. Therefore, there is no evidence to acknowledge the defendant's above assertion, and the defendant's above assertion is without merit.

3. In conclusion, the plaintiff's claim of this case is reasonable, and it is so decided as per Disposition.
