A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On April 6, 2017, the Defendant violated the Act on the Aggravated Punishment, etc. of Specific Crimes (Bodily Injury resulting from Dangerous Driving) was driving a rocketing car under the influence of alcohol leveling to 0.174% in the blood alcohol level from around 09:20 on April 6, 2017, while driving it on the one hand and driving it on the other of Gangseo-gu Seoul Metropolitan Government Yangcheon-ro 47-ro 118 Olympic Games along the roads adjacent to the IC located in the mountain as the 47-ro 118 Olympic Games, and changed the course into the one lane.

In such cases, the defendant engaged in driving of a motor vehicle is likely to impede the driving of a motor vehicle in the lane that intends to change course, he/she shall not change course, and he/she has a duty of care to prevent accidents by operating the direction light in advance and changing the course safely.

Nevertheless, the Defendant, while neglecting alcohol and changing course due to the negligence of changing course, was driven by the victim D(47) driving along one lane in the same room, and received the front part of the victim D(47) taxi driving into the left part of the above rocketing passenger vehicle.

Ultimately, the Defendant, as seen above, driven the said rocketing car in a situation where normal driving is difficult due to the influence of alcohol, and suffered injury to the said victim, such as salt, tension, etc. in need of approximately two weeks of treatment.

2. Around 09:20 on April 6, 2017, the Defendant driven a Crocketing car under the influence of alcohol concentration of about 0.174% in the section of about 10km from the 601-ro 8 high-tech Korean high-tech packing paths from the 101-ro 47-ro, Gangseo-gu, Seoul to the 118 Olympic Games.
