A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

피고인은 2014. 7. 3. 00:20경 서울시 성북구 C에 있는 ‘D 편의점’ 앞 테이블에서, 술을 마시던 중 옆자리에 있던 고등학생인 피해자 E(17세), 피해자 F(17세)이 이야기를 하며 담배연기를 뿜는 것에 화가 난다는 이유로 피해자 F의 뺨을 1회 때리고, 테이블 위에 있던 위험한 물건인 맥주병을 들고 마치 피해자들을 때릴 듯 한 태도를 보이면서 피해자들에게 “야 너네들 얼마 있냐, 까서 나오면 다 뒤진다, 나 출소한지 3일 됐으니 눈에 봬는 것이 없다”라며 겁을 주고, 피해자 E이 돈이 없다고 하자 피해자 E으로 하여금 위 피해자의 우리은행 체크카드를 편의점 앞에 있는 현금지급기에 넣고 비밀번호를 누르게 하여 현금 11만원을 인출하게 하여 위 현금을 교부받았다.
