A defendant shall be punished by imprisonment with prison labor for not more than ten months.

The defendant shall pay 166,500 won to the applicant for compensation by deceit.

3.2

Punishment of the crime

On July 3, 2019, the Defendant posted a false statement to the effect that “D” page of his account “D,” and that the Defendant would send a bank and a slot to the victim E who reported and contacted the sales of the price to the victim E, who read it to the effect that “I would send a bank and a sloter on the face of deposit.”

However, in fact, the Defendant did not have the above goods and did so as to sell them, and it was thought that he would receive money from the victim, and thus, there was no intention or ability to send the said goods even if he received money from the victim.

The Defendant, by deceiving the victim as above, received KRW 492,00 from the F account (G) in the name of the Defendant for the price of goods at around 01:56 on the same day, and received KRW 1,961,00 in total from eight victims, such as the list of crimes, from August 7, 2019, by the same method (attached Form 1) from time until August 7, 2019.

On March 2019, the Defendant sent a false statement to the effect that “I,” “I,” which is a SNS service, connects SNS service,” and “I, sell watchbrogates.” The Defendant sent 155,000 won to the victim K who reported and contacted with the “I,” which was located on the first h third floor of Pyeongtaek-si, Pyeongtaek-si.” The Defendant sent a false statement to the effect that I, “I,” and “I, sell watchbrogates.” The Defendant sent KRW 15,00 to the victim K who reported and contacted this.

However, even if the defendant receives money from the victim as the price for the goods, he thought that it would be consumed due to living expenses, etc., and he did not have the intention or ability to send the victim normally.

As such, the Defendant, by deceiving the victim as such, received KRW 155,00 from the victim on March 27, 2019 to the L account under the name of the Defendant, and acquired KRW 155,00 from the victim on March 15, 2019, as well as from that time until August 21, 2019, this part of the indictment from seven victims is “9.”
