1. The Defendant (Counterclaim Plaintiff) paid KRW 51,383,800 to the Plaintiff (Counterclaim Defendant) and its related amount from August 14, 2013 to September 19, 2014.

1. The following facts may be found either in dispute between the parties or in full view of the entries in Gap evidence Nos. 1, 3, 4, 5, and 7 (including paper numbers), the appraiser C’s appraisal results, and the overall purport of the pleadings:

The Plaintiff is the owner of the building located in Da, Young-si (hereinafter referred to as “Plaintiff-owned building”), and the Defendant is the owner of the building in E (hereinafter referred to as “Defendant-owned building”).

However, around August 13, 2013, the F’s employees G caused a fire with care due to the corrosion from the outside of the second floor of the Defendant’s building owned by the Defendant during the process of melting the fire, and caused damage or contamination of the stone outer wall and glass of the Plaintiff’s building while scattering of melted water, and caused contamination of the interior walls, floors, etc. inside the building through the windows of the interior and the stairs room of the Plaintiff’s building owned by the Plaintiff at the time, through which the noise, smoke, etc. came into the inside of the building.

A. According to the above recognition of the occurrence of damages liability, the defendant is obligated to compensate for the damages suffered by the plaintiff due to the instant fire as a G employer.
