1. Defendant A shall be punished by imprisonment for three years.

However, the above sentence shall be executed for a period of five years from the date this judgment became final and conclusive.

M은 2014년 경부터 현재까지 위 O의 직원 및 ㈜Q 의 사내 이사로 근무하고 있는 사람으로서 위 A의 배우자이다.

2. 범죄 사실 피고인들 및 M은 2014. 2. ∼5. 경 부산 해운대구 N에 있는 위 ㈜Q 사무실 등지에서 공모하여, ① 피고인 B는 피해자 엔에이치엔 (NHN)㈜ 가 운영하는 인터넷 포털사이트인 네이버 (Naver) 의 IP 필터링 인터넷 포털 사들은 검색 순위 조작 등을 막기 위하여, 동일하거나 유사한 IP 대역에서 집중적으로 트래픽이 발생하는 경우 이를 검색 순위 산정에서 제외시키는 등의 ‘ 필터링’ 조치를 취하고 있다.
