The action for retrial shall be dismissed.

The litigation costs for retrial shall be borne by the plaintiff.

The grounds for request for retrial shall be examined.

The Plaintiff (hereinafter “Plaintiff”) asserts to the effect that there was a ground for retrial in the instant judgment subject to a retrial.

In light of the records, the plaintiff filed a request for retrial for the same or similar reasons as the lawsuit of this case, and received a dismissal judgment and dismissal judgment. The lawsuit of this case is filed repeatedly for the same or similar reasons as the previous request for retrial, and thus, it is inappropriate to permit it as it constitutes abuse of the right of lawsuit.

Therefore, the retrial suit of this case is dismissed, and the costs of the retrial are assessed against the losing party. It is so decided as per Disposition by the assent of all participating Justices.
