1. The Defendant’s KRW 70,000,000 and its interest thereon to the Plaintiff are 15% per annum from May 13, 2019 to May 31, 2019.
Reasons
1. The description of the grounds for the claim shall be as specified in the attached Form;
(However, the “creditor” is deemed to be the “Plaintiff”, and the “debtor” shall be deemed to be the “Defendant”). 2. Judgment without pleading (Article 208(3)1 of the Civil Procedure Act)
3. According to the main sentence of Article 3(1) of the Act on Special Cases Concerning Expedition, etc. of Legal Proceedings for Partial Dismissal (amended by Presidential Decree No. 29768, May 21, 2019), the statutory interest rate under the main sentence of Article 3(1) of the Act on Special Cases Concerning Expedition, etc. of Legal Proceedings is 12% per annum from June 1, 2019. Thus, the portion of damages for delay seeking payment exceeding the rate of 12% per annum from June 1, 2019 is rejected.
