1. Revocation of a judgment of the first instance;
2. All of the plaintiff's claims are dismissed.
3. All costs of the lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. On February 19, 2002, Defendant A entered into an insurance contract with the Plaintiff, the insured, and the beneficiary as Defendant A (hereinafter “instant insurance contract”).
The policyholders and beneficiaries of the instant insurance contract were changed to Defendant B, which was the son of Defendant A, on December 22, 2003, and changed to Defendant A again on November 4, 2008.
B. From February 5, 2004 to March 8, 2004, Defendant A received hospital’s hospitalization for 33 days from urology as well as treatment for 35 days in total by October 15, 2013 as indicated below.
In relation to the above hospitalization, the Plaintiff received respectively the insurance money of KRW 30,675,697 (the total sum of KRW 34,940,809, and KRW 34,025,234 and KRW 68,96,043) from the Plaintiff, Defendant A, and Defendant B, respectively.
