All of the first and second original judgments shall be reversed.

A defendant shall be punished by imprisonment for two years.

1. Summary of grounds for appeal;

가. 피고인 ⑴ 사실오인 ㈎ 제1원심판결 중 피해자 T 부분에 관하여 피고인은 AH와 함께 피해자의 투자금으로 부산, 대구지점을 설립ㆍ운영하기로 하였을 뿐 공소사실과 같은 사업현황이나 재무상태에 관한 거짓말을 하지 않았고, V지점의 경우 상호권 분쟁 종결 후 설립ㆍ운영하기로 하여 투자금을 미리 받았던 것이지 이미 운영중인 것처럼 거짓말을 한 사실이 없으며, 이모티콘 캐릭터 사업의 경우 실제로 진행을 하였으므로 피해자를 기망한 것이 아니다.

㈏ 제1원심판결 중 피해자 AC 부분에 관하여 피해자는 T의 처 AJ의 설명을 듣고 T의 부산 및 대구지점 투자자 지위를 이어받기로 하였던 것이지, 피고인이 피해자를 기망한 사실은 없다.

㈐ 제2원심판결(피해자 D)에 관하여 피고인은 피해자로부터 5,000만 원을 투자받았으나 예상외로 수익이 나지 않았던 것일 뿐, 편취할 의도로 위 돈을 차용한 것이 아니었다.
