A defendant shall be punished by imprisonment for seven months.
Reasons
Punishment of the crime
1. Around December 20, 2014, the Defendant against the victim B made a false statement to the effect that “Around December 20, 2014, the Defendant purchased the land from the Plaintiff and newly built a warehouse. In order to newly construct a warehouse, the Defendant borrowed KRW 2 million as the construction contract deposit, as it is necessary to construct a new warehouse, to build a new warehouse. The Defendant would pay a balance after the completion of the previous construction, and thus, he/she would pay the remainder.”
However, in fact, the Defendant did not use 2 million won borrowed from the victim as the down payment for banking construction, and there was no intention or ability to repay as agreed even if the Defendant borrowed money from the victim due to no particular asset or income.
Nevertheless, the Defendant received KRW 2,00,000 from the victim to the F Bank account (G) in the name of E, the Defendant, as the same day borrowed from the victim, from around October 2015, and received KRW 4,198,000,000 in total as the statement in the crime list, by deceiving the victim over 25 times in total, as shown in the attached crime list, and being delivered as the borrowed money.
2. Around May 29, 2015, the Defendant against the victim H made a false statement to the effect that “The victim H, who is a son in B, becomes aware of a large number of people in the construction site,” and “a large number of people are available for money by operating the manpower office. He/she requests the Seoul Manpower Office’s business operator to transfer KRW 1.1 million to the Seoul Manpower Office’s down payment, which is to be used as the down payment. In order to operate the manpower office, the Defendant would have a certain qualification only if the wife was born, and thus, he/she would operate the manpower office under his/her name.”
However, the identity of the defendant was not the son, and there was no intention or ability to take over the manpower office.
Nevertheless, the defendant is 110,000 won from the victim as the down payment on the same day.
