The judgment below

Examining the reasoning of the judgment below in light of the relevant legal principles and records, the court below reversed the judgment of the court of first instance which convicted Defendant A, B, C, and D of violation of the Act on Assembly and Demonstration due to non-compliance with the dispersion Order and each of the facts charged in this case against Defendant E and G is just in accordance with the purport of the judgment of remanding. In so doing, the court below did not err by misapprehending the legal principles on facts beyond the bounds of the principle of free evaluation of evidence against the logical and empirical rules or by misapprehending the legal principles on non-compliance with the dispersion

On the other hand, the prosecutor appealed each part of the judgment of the court below (the charge against the defendant A, B, C, and D of violation of the Act on Assembly and Demonstration due to the Non-Report Demonstration). However, there is no indication of the grounds for appeal in the petition of appeal and there is no statement of grounds for appeal in the appellate brief.

Therefore, all appeals are dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
