The appeal is dismissed.
The costs of appeal are assessed against the Plaintiff.
Reasons
The grounds of appeal are examined.
1. As to the ground of appeal No. 1, the lower court rejected the Plaintiff’s assertion that the part of the instant comprehensive insurance on the Plaintiff’s inventory property owned by the Plaintiff including neglect and food corporation (hereinafter “the instant insurance”) is the liability insurance for the Plaintiff. However, in light of the motive and background of entering into the instant insurance contract, the purpose and scope of the instant comprehensive insurance on the instant property, and the insured’s insurable interest in the instant insurance, it is insufficient to deem the instant insurance as the liability insurance with which the Plaintiff is the insured, and rather, the instant insurance is deemed as property insurance for a third party who entrusted the Plaintiff with the custody of inventory property as the insured, such as neglect and Doo (hereinafter “Doo”) on the ground that the instant insurance is reasonable.
The judgment below
Examining the reasoning of the judgment below in light of the relevant legal principles and records, the above judgment of the court below is acceptable.
In so doing, contrary to what is alleged in the grounds of appeal, there were no errors by exceeding the bounds of the principle of free evaluation of evidence in violation of logical and empirical rules, or by misapprehending the legal principles on the insurance policy and
2. As to the grounds of appeal Nos. 2 and 3, the lower court, on the grounds as indicated in its reasoning, determined that the insurance proceeds related to the Plaintiff’s neglect of duty as a customer and the loss incurred to the inventory movable property entrusted with the custody of the said property by tugboat descendants constituted the sum of the manufacturing cost based on the negligence and tugboat loss, and the distribution cost to the Plaintiff
Furthermore, the lower court is in the instant claim seeking the payment of insurance proceeds.
