1. The defendant shall receive KRW 10,000,000 from the plaintiff, and at the same time, shall record the plaintiff's ground documentary evidence in Gui-si C.
Reasons
Basic Facts
On June 24, 2015, the Plaintiff acquired ownership by winning the instant land at a voluntary auction procedure (Ji-gu District Court D and E) concerning the area of 360 square meters (hereinafter “instant land”).
On September 3, 2002, the deceased on February 29, 2008, G, H, I, and J (hereinafter “G et al.”) completed the registration of ownership transfer (G3/9 shares, H, I, and J 2/9 shares, respectively) of the instant building by inheritance on February 29, 2008, after completing the registration of ownership transfer for the instant building on February 29, 2008.
On the other hand, the defendant completed a move-in report on the building of this case on October 31, 201 and currently resides in the building of this case.
Examining the current status of the instant building and the instant land, the instant building is located on the part (B) of 55 square meters in the ship (hereinafter “instant flooded building”) connected in order to each point of the attached Form No. 27, 10, 11, 32, 22, 23, and 27 among the instant land, and the part occupied and used due to the existence of the instant flooded building is 67 square meters in the part of the “three-dimensional” portion among the instant land (hereinafter “instant flooded building”) connected in order to each point of 28,9, 10, 11, 32, 22, 23, 27, and 28 of the attached Form No. 28,9, 10, 10, 32, 222, 27, and 28.
Meanwhile, the amount equivalent to the rent for the instant sunken site is KRW 29,000 per month from June 27, 2015 to June 26, 2016, and is KRW 308,00 per month from June 27, 2016 to August 12, 2016.
On September 10, 2015, the Plaintiff filed a lawsuit for demolition of buildings, etc. with G and three other parties at the Daegu District Court 2015Gadan4214, and on October 19, 2016, the Plaintiff filed the lawsuit at the rate of KRW 308,00 per month from June 27, 2015 to June 26, 2016 or from June 27, 2016 to June 308, 200, respectively.
