피고인들은 2016. 9. 19. 02:00경 경남 의령군 의병로7길에 있는 서동 공용주차장에서 길을 가던 중 피고인 A이 피해자 C(31세)과 눈이 마주쳤다는 이유로 시비되어, 피해자가 휴대전화를 꺼내며 “싸우면 녹음한다”는 등의 말을 하자 피고인 A은 손으로 피해자의 휴대전화를 쳐서 떨어뜨린 다음 주먹으로 피해자의 얼굴을 수회 때려 피해자를 넘어뜨리고, 피고인 B은 이에 합세하여 피고인 A과 함께 피해자를 붙잡아 주차장 안쪽으로 끌고 들어가고, 주먹과 발로 피해자의 얼굴 등을 마구 때리고 걷어찼다.
