A defendant shall be punished by imprisonment for seven months.
Reasons
Punishment of the crime
1. Around December 15, 201, the Defendant committed the crime against the Victim B, the Defendant called “A” at the home of D located in Chungcheongnam-si, Chungcheongnam-si, Chungcheongnam-si, that “A dry field approximately KRW 40 million in the vicinity of Jin-si, Jin-si, leased approximately KRW 1 million to the victim B, one-year leading site, and two million won.”
However, in fact, the above land is owned by F, and the father of the defendant leases it to a farmer, and there was no permission from his father to lend the above land to another person. Therefore, even if the victim received a leading land from his father, there was no intention or ability to lease the dry field to the victim.
Nevertheless, the Defendant was issued 2 million won under the same day as the victim’s leading in the same day.
2. The Defendant committed the crime against the victim D around January 16, 2012, saying, at the home of the victim D located in Chungcheongnam-si, Chungcheongnam-si, Chungcheongnam-si, that “A person who has leased farmland from his father, etc. in his/her native father, etc. in his/her native family has leased approximately KRW 3,840,000,000,000 per annum, such as G, H, I, J, K, K, and L, for three years.”
However, the above land is owned by M and N, and the defendant's parents leased the above land and took a farming house, but the defendant did not have obtained permission from his parents to lend the above land again, so even if he received the guidance from the victim, he did not have the intention or ability to lease dry field to the victim.
Nevertheless, the Defendant, as seen above, was issued 1.8 million won on the same day from the victim, and 2.4 million won on the 20th of the same month respectively.
In addition, the Defendant received a total of KRW 2,757,00 from the victims on 13 occasions, as shown in the attached list of crimes, from December 15, 201 to April 201, 201.
