Reasons
1. Basic facts
A. B Co., Ltd. (hereinafter “B”) entered into a new business of building and selling D, “D” (hereinafter “instant commercial building”) on the ground of Kimpo-si, Kimpo-si (hereinafter “instant land”). B, a stock company, the Korea Investment Savings Bank (hereinafter “Korea Investment Savings Bank”), entered into a contract on May 12, 2015, for the purpose of financing its business funds from the Korea Investment Savings Bank (hereinafter “Korea Investment Savings Bank”) and a real estate security trust agreement (hereinafter “instant trust agreement”), and completed the registration of ownership transfer with respect to the instant land on May 20, 2015.
B. (1) The Plaintiff concluded a sales contract with B to purchase the E-building Nos. 107, 108, 109, 204 and 304 (hereinafter collectively referred to as “each of the instant real estate”) as follows (hereinafter “instant sales contract”).
The purchase price of housing units contract No. 107 and February 16, 2015, KRW 108,550,64 million, KRW 108,500,000 on March 2, 2015, KRW 109,520,000 on April 7, 2015, KRW 204, KRW 204,69,000 on February 16, 2015, KRW 304, KRW 665,60,00 on February 16, 2015, KRW 200,000 on each of the instant real property on August 31, 2015, and the registration of ownership transfer was completed on the same day, and completed on the same day, on August 31, 2015, for the trust of Rose Co.,, Ltd. (hereinafter referred to as “pathized trust”).
(3) On April 15, 2016, the Plaintiff: (a) completed the registration of ownership transfer in the name of the Rose of Sharon on April 107 (the merger was made on March 25, 2016), 108 (the classification was made on March 25, 2016), and 204; and (b) on the same day, the registration of the trust in the name of the Rose of Sharon was cancelled due to the disposal of the trust property; and (c) the registration of the trust in the name of the Rose of Sharon was completed on April 15, 2016 by taking the trust in the name of another Rose of Sharon as the trustee.
C. (1) The Defendant is located in B on November 9, 2015 and in the instant commercial building.
