The prosecution of this case is dismissed.

1. At around 01:00 on May 16, 2019, the Defendant: (a) expressed that the victim D(44 years old) intends to park a truck for the delivery of the instant cargo in front of the C convenience store located in Gangdong-gu Seoul Metropolitan Government; (b) expressed the victim’s desire to stop in front of the defect; and (c) expressed the victim’s shoulder and body “I am am hack hack hack hack hack, hack hack hack hack, hack hack hack hack, hack hack hack, hack hacks the victim’s shoulder and body by hand; and (d) assaulted the victim, such as the victim’s face.

2. The court below's decision that the victim was not subject to punishment, and Article 327 subparagraph 6 of the Criminal Procedure Act;
