Reasons
Punishment of the crime
1. On November 22, 2019, the Defendant made a false statement to the victim D (D, 33 years of age, leckckisttan) who had contacted the Defendant with the phrase “I will sell smartphones 10 in gallon city” posted to C at an unspecified place on November 22, 2019.
In fact, the Defendant did not have smartphones and did not have the intent and ability to send smartphones even if he receives the payment from the victim.
As above, the Defendant, by deceiving the victim, received 400,000 won from the victim to the company bank account (E) under the name of the Defendant for the sale of smartphones on the same day, and received 4,195,000 won in total from the 17 victims to the above company bank account and the F bank account (G) account in the name of the Defendant from February 4, 2020 as shown in the list of crimes in the attached list of crimes.
2. On November 24, 2019, the Defendant posted a letter stating that he/she would sell S10 mobile phones in 350,000 won at a gallon gallon on the Internet at “H,” which is a business site for trading used goods at an off-site, at an off-site location, and said that he/she would first forward KRW 350,000 to the victim I who reported and contacted this letter to the victim I, who would send the said mobile phone as the price for the said mobile phone, and then send it to the cell phone on the face of the week.

As above, the Defendant, by deceiving the victim, received KRW 350,000 from the victim to the above F Bank account (G) on the same day, and from that time, received total of KRW 1,010,000 from five victims from February 1, 2020, as shown in the annexed crime list from February 1, 2020.
