The defendant shall be innocent.
Reasons
1. The summary of the facts charged is a person who served as the head of the organization support office of the B political party’s entire North Korean Dos from around August 2016 to March 22, 2018 and who processed personal information, such as entering a list of party members stating the personal information of party members of the B political party, or managing party members.
No person who has managed or processed personal information shall divulge personal information he/she has become aware of in the course of performing his/her duties or provide it to another person without authority.
At around 20:30 on April 11, 2018, the Defendant: (a) registered the 7th time as a preliminary candidate for the F Party B of the Dong-si Local Election E-gu Seoul Metropolitan Government (G, H, I, and J) in the front parking lot located in C; (b) issued K the 853 personal information stored, such as G, H, I, and J, among the party members of the Jeonbuk-do Party B before the political party, one copy of the U.S.B mera of which the X-gu unit was mortgaged.
Accordingly, the defendant disclosed personal information that he became aware of in the course of his duties and provided it to others without authority.
2. Article 59 Subparag. 2 of the Personal Information Protection Act prohibits a person who manages or processed personal information from either disclosing personal information that he/she has become aware of in the course of his/her duties or providing such information to another person without authority (Article 59 Subparag. 2).
(Article 71 subparag. 5). According to the evidence duly examined, the Defendant: (a) while working as the head of the organization support office of the B party branch; (b) received from the Central Party an X-cell file containing a list of party members of the B party branch from the Central Party on December 2017 to classify it by region; and (c) around April 20:30 of 2018, the Defendant 850 members of the B party branch from the front parking lot of D to K on April 11, 2018 (including 255 members of the right, 598 members of the ordinary Party); and (d) delivered one name, telephone number, address, and mail number to K.
