The defendant's appeal is dismissed.
Reasons
The summary of the grounds for appeal is that the defendant, as the vehicle of the victim prevents the way, demanded the victim to turn off the way, the victim took the her bath, and thereafter, he was paid the her son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's
The sentencing of the court below's improper sentencing (one million won in penalty) is too unreasonable.
According to the evidence duly admitted and examined by the lower court on the grounds of appeal, the lower court’s assertion of misunderstanding of the facts as to the grounds for appeal was duly admitted and examined: ① the Defendant: (a) reported the victim’s vehicle on the alleyway while getting on and off a taxi operated by F, and demanded the victim to move the vehicle from the taxi; (b) the victim was driving the vehicle about to get out of the said place; and (c) the victim’s vehicle driving on the front of the victim’s vehicle in order to prevent the victim from driving the vehicle; and (d) the victim’s vehicle driving on the front of the victim’s vehicle to cause damage; and (b) the Defendant was faced with the victim’s vehicle by a taxi operated by F or by the Defendant and C;
On December 14, 2015, the fact that the report was filed with 112; 3) on December 14, 2015, the Dongdaemun Police Station prepared a written statement to the effect that the injured person left the said taxi after leaving the said taxi, and C was faced with the vehicle in front of the (victim) and the taxi was faced with the vehicle in front of the vehicle and went into the sea.
The Defendant written the statement to the effect that “the victim was able to take a taxi due to the aftermath of the victim’s vehicle and escaped from the scam in alley,” and that the Defendant also prepared a written statement to the effect that “C does not want to be punished” at the same police station at the time of preparing a written statement of traffic accident occurrence.
“The Defendant entered the lower judgment,” and the Defendant did so.
