Defendant
A As the representative director of P Co., Ltd. (hereinafter referred to as "P") located in Pyeongtaek-siO, a person manufacturing and installing pellets, a wood boiler, who is an agricultural wood boiler, is selected as a subsidiary operator of pelpellets installation support projects implemented by a local government under the delegation of the Ministry of Agriculture, Food and Rural Affairs.
The support project for installation of pellets is a project that grants 40% of the total project cost to the installer of the boiler at his own expense the remainder of 60% of the project cost to the installer of the boiler.
The Defendants were aware that Defendant A remitted self-paid funds to be paid by assistant business operators, including Defendant B, Defendant C, Defendant D, and Defendant E, and then deposited them again into the Agricultural Cooperative account in the name of P, or that Defendant A paid self-paid funds to the Agricultural Cooperative account in the name of Defendant B, Defendant C, Defendant D, and Defendant E by depositing them into the Agricultural Cooperative account in the name of Defendant B, Defendant C, Defendant D, and Defendant E. The Defendants were willing to unlawfully receive subsidies from the competent local government.
1. Around November 2010, Defendant A agreed to bear the full amount of KRW 16,160,000 of the self-paid charges to be borne by B at the establishment of the facility in Q Q in Kimhae-si, and installed one pellets boiler equivalent to KRW 40,400,000.
Around that time, the Defendant remitted KRW 11,760,00 to the Agricultural Cooperative Account in the name of NA, the Defendant: (a) deposited the said money again to the Agricultural Cooperative Account in the name of P; (b) deposited KRW 4,400,000 to the Agricultural Cooperative Account in the name of P; and (c) on February 21, 2011, the Defendant paid KRW 2401 to B while applying for subsidies to the Kimhae-si Agricultural Management and the employee in charge of Kimhae-si in the name of Kim Sea as of February 21, 2011.
