Reasons

1. Facts of recognition;

A. C completed the registration of ownership transfer on September 11, 2013 regarding the real estate listed in the separate sheet (hereinafter “instant real estate”).

B. On September 11, 2013, the Plaintiff established the right to collateral security of KRW 175,500,000 with respect to the instant real estate, and loaned KRW 135,00,000 to C.

C paid only interest by February 2014 to the Plaintiff, and later paid the loan obligation in arrears.

C. On February 12, 2014, the Defendant concluded a lease contract (hereinafter “instant lease contract”) with the term “28,000,000 won” and “from February 12, 2014 to May 12, 2016,” with respect to the instant real estate as agent D and the instant real estate.
