1. On April 201, 201, the Defendant, at the Defendant’s office located in Dongdaemun-gu Seoul Metropolitan Government Building C Dong-gu, 406, may bring profits to the victim D and E to the amount of KRW 14 million per month when operating the C-building underground parking lot.

On the face of KRW 100 million, a false statement was made that the above underground parking lot will be leased.

Nevertheless, as seen above, the Defendant received 50 million won from the victim E to the account in the name of the Defendant on June 1, 2011, and acquired it by transfer from the victim E, and it received 50 million won from the victim D to the above office on June 3, 2011.

2. On June 1, 2011, the Defendant, at the office described in the above paragraph (1) around June 1, 201, held a copy of the foreign currency check of USD 100,000 to the victim D (referred to as “F,” “A,” and “the date of payment” August 10, 201), and, at the same time, leased the C-dong underground parking lot in the C-dong building, if the check is changed in cash.

A check was presented on August 10, 201, the date of presentation for payment, which was false.

However, in fact, the defendant was not the owner or lessee of the above C-dong Underground Parking Lots, and there was no fact that the owner or lessee was granted the right to lease the above underground parking lot from the owner or lessee, so the defendant would have to lease the above underground parking lot to the victim.
