1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Comprehensively taking account of the overall purport of arguments as to the statements in Gap evidence Nos. 1 and 3, the plaintiff was the owner of the real estate listed in the attached Table No. 1 (hereinafter "real estate No. 1"), the real estate listed in paragraph (2) of the attached Table No. 2 (hereinafter "real estate No. 2") among the real estate listed in the attached Table No. 1, the real estate No. 2, and the real estate No. 1. 2, the real estate No. 4383, Mar. 23, 1984, and March 12, 1984, with regard to each of the real estate of this case as the ground for registration No. 4383, Mar. 23, 1984.
2. The assertion and judgment
A. The summary of the plaintiff's assertion 1) At the time of around 1984, the representative C received documents and certificates of personal seal concerning each of the real estate of this case from the plaintiff, and at his discretion, without the plaintiff's permission, completed the registration of ownership transfer under the name of the defendant clan with respect to each of the above real estate owned by the plaintiff. The plaintiff seeks cancellation of each of the above registrations illegally closed against the defendant clan. 2) At the time of around 1984, the representative C paid the money after concluding a sales contract for each of the above real estate of this case with the plaintiff following the resolution of the general meeting of the clan, and accordingly, completed the registration of ownership transfer in the future of the defendant clan.
B. There is no evidence to acknowledge that the defendant clan completed the registration of ownership transfer of each of the real estate of this case from the plaintiff without going through legitimate procedures at around 1984.
Rather, in full view of the entries of the evidence Nos. 1 and 2 (each sales deed) and the testimony of the witness C, the defendant clans made a sales contract with the plaintiff about each of the real estate of this case after the resolution of the general meeting of the clans around 1984.
